The growing use of generative artificial intelligence (AI) in the legal profession, including international arbitration, creates moral, legal and technical challenges for arbitral users, including arbitrators, counsel and parties to proceedings. Unlike traditional legal technology platforms, the use of generative AI potentially threatens the integrity and fairness of proceedings. The concept of disclosure in arbitration proceedings is well-established and principles underpinning disclosure of other risks may be usefully applied to some of the risks posed by generative AI in arbitration proceedings. We propose a series of proposed disclosure triggers relating to the use of generative AI that may prove effective in mitigating the potential challenges posed by generative AI in the arbitration context, while at the same time maximising the potential benefits of generative AI to the practice of international arbitration.
